Today, October 30, 2026, our Director, ๐๐ซ๐จ๐๐๐ฌ๐ฌ๐จ๐ซ ๐ ๐๐๐๐ซ๐ข๐๐จ ๐ ๐๐ซ๐จ๐ฅ๐๐ข, spoke at the ๐๐๐ญ๐ก ๐๐๐๐ ๐๐ง๐ง๐ฎ๐๐ฅ ๐๐จ๐ง๐ ๐ซ๐๐ฌ๐ฌ (Italian Association of Copyright Law), currently taking place in Genoa, Italy (Session Chair: Professor Michele Bertani)
This yearโs congress focuses on ๐ ๐๐ง๐๐ซ๐๐ญ๐ข๐ฏ๐ ๐๐ ๐๐ง๐ ๐ข๐ง๐ญ๐๐ฅ๐ฅ๐๐๐ญ๐ฎ๐๐ฅ ๐ฉ๐ซ๐จ๐ฉ๐๐ซ๐ญ๐ฒ. Professor Faroldi presented his ๐ฉ๐๐ซ๐ข๐ญ๐ฒ ๐ญ๐ก๐๐ฌ๐ข๐ฌ: if a human creates by making certain choices, then a system that makes the same choices, in the same functional sense, creates too.
Professor Faroldi further argued that ๐๐ซ๐๐๐ญ๐ข๐จ๐ง ๐ฌ๐ก๐จ๐ฎ๐ฅ๐ ๐๐ ๐ฎ๐ง๐๐๐ซ๐ฌ๐ญ๐จ๐จ๐ ๐๐ฌ ๐ ๐๐จ๐ซ๐ฆ ๐จ๐ ๐๐๐ญ๐ข๐จ๐ง, and that the Court of Justiceโs criterion of โfree and creative choicesโ can be understood as a test of selection โ one that a generative agent can also satisfy.
This perspective raises important questions about the implications of generative AI for traditional legal notions of ๐๐ฎ๐ญ๐ก๐จ๐ซ๐ฌ๐ก๐ข๐ฉ, the ๐๐ซ๐๐๐ญ๐จ๐ซ, and ๐ฉ๐๐ซ๐ฌ๐จ๐ง๐๐ฅ๐ข๐ญ๐ฒ.
